Terms of Service

1. About these Terms

These Terms of Service ("Terms") govern the provision of sport and exercise psychology services by WholeMind Sport Psychology ("we", "us"). WholeMind Sport Psychology is the trading name/business through which Robert Ogborn provides the services described in these Terms. Robert Ogborn is a Sport and Exercise Psychologist in Training (SEPiT) undertaking the BASES Sport and Exercise Psychology Accreditation Route (SEPAR), with his professional work undertaken with appropriate professional supervision.

These Terms apply to consumers who purchase services from WholeMind Sport Psychology. They should be read alongside the WholeMind Sport Psychology Privacy Notice and, where applicable, the Client Service Agreement and consent/confidentiality documentation.

2. Nature of the service

WholeMind Sport Psychology provides individualised sport and exercise psychology support intended to assist clients with psychological, mental and behavioural aspects of sporting performance and participation. The precise focus of support will be agreed with the client and may change as the work develops.

The service is not an emergency or crisis service and is not a substitute for emergency medical care, psychiatric care, medical assessment or other specialist services where these are required. Where WholeMind Sport Psychology considers that another service or professional is more appropriate, this may be discussed with the client and, where appropriate, a referral or signposting may be recommended.

No particular sporting, psychological or performance outcome can be guaranteed. Psychological support is individualised and outcomes depend on a range of factors, including the client's circumstances, engagement and factors outside WholeMind Sport Psychology’s control.

3. Professional status and supervision

Robert Ogborn is a Sport and Exercise Psychologist in Training (SEPiT) undertaking the BASES Sport and Exercise Psychology Accreditation Route (SEPAR). His work is undertaken with professional supervision. Clients will be informed of this status and the relevant supervision arrangements before or at the start of the professional relationship.

4. 1:1 Services

All 1:1 sessions have a maximum duration of 50 minutes. Fifty minutes is a maximum and a guide rather than a target. Robert may conclude a session earlier where he considers this clinically appropriate or in the client's best interests. The exact duration of an individual session therefore cannot be guaranteed.

Prices shown include any VAT that WholeMind Sport Psychology is legally required to charge, if applicable. If the business's VAT status changes, prices will be displayed in accordance with applicable law before a new purchase is made.

5. Booking and contract formation

Bookings are made through the WholeMind Sport Psychology website or another booking method expressly authorised by WholeMind. The booking process will identify the service, price and applicable payment arrangements. A contract is formed when WholeMind Sport Psychology accepts the booking and payment has been successfully processed, subject to any applicable statutory cancellation rights.

The person making the purchase is responsible for providing accurate contact and booking information. For clients under 18, the parent or guardian with parental responsibility will normally be the contracting customer for the financial arrangements, while the young person remains the recipient and primary participant in the psychological support.

6. Online purchases and statutory cancellation rights

Where the contract is a distance contract, consumers may have a statutory 14-day cancellation period under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Nothing in these Terms removes or reduces a statutory right.

If a client asks WholeMind Sport Psychology to begin providing the service during the statutory cancellation period, WholeMind will obtain the express request required by applicable law. If the client subsequently exercises a statutory cancellation right during that period, the client may be required to pay a proportionate amount for services properly supplied up to the point of cancellation, where the law permits this.

If a service has been fully performed after the client's express request for it to begin during the cancellation period and the client acknowledged the effect of full performance on the cancellation right, the statutory right to cancel may no longer apply to that service, as provided by law.

Where a statutory cancellation right applies and is exercised validly, refunds will be made in accordance with the applicable legal requirements.

7. Single-session services

A single-session purchase provides one sport and exercise psychology session of up to 50 minutes. A single session remains valid for one month from purchase, subject to these Terms. WholeMind Sport Psychology may extend this period at its discretion where reasonable circumstances make this appropriate, including illness, injury, competition, training, examinations or other circumstances affecting the client's ability to begin the programme.

The 24-hour appointment cancellation/rescheduling provisions in section 9 apply to single sessions.

8. Session programmes and bundles

WholeMind Sport Psychology offers discounted 5-session and 10-session programmes. The programme fee is paid in full in advance. The discounted price reflects the client's commitment to purchasing a programme of multiple sessions rather than individual sessions at the standard single-session price.

The first session should normally take place within one month of purchase. WholeMind Sport Psychology may extend this period at its discretion where reasonable circumstances make this appropriate, including illness, injury, competition, training, examinations or other circumstances affecting the client's ability to begin the programme. An extension does not by itself mean that the programme has commenced.

If a scheduled first session is cancelled or missed with less than 24 hours' notice, WholeMind Sport Psychology reserves the right to treat that appointment as used and retain the standard single-session fee of £49.99. WholeMind may waive this provision at its discretion, including where circumstances reasonably justify doing so.

Once the first session has taken place, the programme is considered commenced. A client may choose to stop receiving psychological support at any time and does not need to provide a reason. However, once a programme has commenced, the programme fee is not ordinarily refundable solely because the client chooses to discontinue.

WholeMind Sport Psychology may, at its discretion, provide a partial or full refund or another appropriate adjustment where exceptional or reasonable circumstances justify doing so. Any refund or adjustment will take account of the services already provided, the nature of the programme purchased and applicable law.

The standard validity period for a programme is 12 months from purchase. WholeMind Sport Psychology may extend the validity period at its discretion where reasonable circumstances make an extension appropriate. Unused sessions do not automatically roll into a new programme.

Programmes containing more than 10 sessions are available by individual quotation and may be subject to bespoke written terms agreed before purchase.

9. Cancellations and rescheduling

Clients are asked to provide at least 24 hours' notice when cancelling or requesting to reschedule an appointment.

The 24-hour period is a standard notice requirement, not an absolute prohibition on late changes. WholeMind Sport Psychology may, at our discretion, accept a cancellation or rescheduling request made with less than 24 hours' notice.

Where an appointment is cancelled or missed with less than 24 hours' notice, WholeMind Sport Psychology reserves the right to treat the appointment as used or charge the applicable single-session fee, subject to applicable law and the circumstances of the cancellation. A decision to waive the requirement on one occasion does not prevent it being applied on a future occasion.

WholeMind Sport Psychology will aim to provide at least 24 hours' notice if an appointment needs to be cancelled or rescheduled. Where circumstances make this impractical, WholeMind Sport Psychology will offer an alternative appointment where reasonably possible. If WholeMind Sport Psychology cannot provide a purchased session and cannot offer a suitable alternative, the client will receive any refund or other remedy required by applicable law and these Terms.

10. Between-session WhatsApp support

Where agreed as part of the service, WholeMind Sport Psychology may provide between-session WhatsApp support. This is intended for appropriate communication connected with the ongoing work and is not an emergency or crisis service.

WholeMind Sport Psychology does not guarantee a particular response time. Clients should not rely on WhatsApp for urgent matters or situations requiring immediate assistance.

For clients under 18, direct WhatsApp communication with the young person will only take place through a parent/guardian or where the parent/guardian has provided explicit consent for direct communication between the young person and WholeMind Sport Psychology.

11. Confidentiality and safeguarding

Confidentiality and information-sharing arrangements are explained in the relevant consent and confidentiality documents. WholeMind Sport Psychology will handle client information in accordance with professional, legal and data protection requirements.

Confidentiality is not absolute. Information may need to be shared where required or permitted by law, where there is a serious concern about a client's safety or another person's safety, where there is a safeguarding concern, or where sharing is otherwise necessary to meet professional or legal responsibilities. Where appropriate and possible, WholeMind will discuss this with the client before information is shared.

12. Client responsibilities

  • Provide accurate and relevant information needed to provide the service.

  • Attend appointments at the agreed time and give reasonable notice when changes are required.

  • Treat Robert and any other people involved in the service respectfully.

  • Tell WholeMind Sport Psychology about circumstances that may materially affect the delivery of the service.

  • Use communication channels, including WhatsApp, appropriately and not as an emergency service.

  • Not record sessions or reproduce session materials without prior agreement.

13. WholeMind Sport Psychology's professional boundaries and discretion

WholeMind Sport Psychology may determine that a particular request, intervention or working arrangement is outside the appropriate scope of the service or Robert's competence or supervision arrangements. Where possible, WholeMind Sport Psychology will discuss appropriate alternatives, signposting or referral.

WholeMind Sport Psychology may decline or end a professional relationship where there is a legitimate professional, safeguarding, ethical or practical reason to do so. Where the client is not at fault, WholeMind Sport Psychology will, where appropriate, provide reasonable notice and/or a refund or alternative arrangement for services not provided, subject to applicable law.

14. Complaints

If a client is dissatisfied with the service, they should first contact Robert Ogborn at support@wholemindsport.com and explain the concern. WholeMind Sport Psychology will acknowledge the complaint and seek to respond reasonably and proportionately.

Where the concern relates to professional practice, clients may also raise the matter through any applicable professional or regulatory route. WholeMind Sport Psychology will provide relevant information about the appropriate route where reasonably requested. 15. Data protection and privacy

WholeMind Sport Psychology's Privacy Notice explains what personal information is collected, why it is used, the lawful bases for processing, retention, sharing, security and the rights available to individuals. The Privacy Notice is available at https://www.wholemindsport.com/privacypolicy

Psychological support may involve information concerning physical or mental health. Health information is special category personal data under UK data protection law and is subject to additional requirements. WholeMind Sport Psychology will process such information only where an appropriate lawful basis and additional special-category condition apply.

16. Intellectual property and session materials

Unless otherwise stated, materials created by WholeMind Sport Psychology or Robert for use in sessions remain the intellectual property of WholeMind or the relevant rights holder. Clients may use materials supplied to them for their own personal development and sporting purposes but should not reproduce, sell or distribute them commercially without permission.

17. Liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or statutory consumer rights that cannot be excluded.

Subject to the above, WholeMind Sport Psychology is not responsible for losses caused by circumstances outside its reasonable control, including changes to sporting schedules, travel, illness, technical failures or other events beyond reasonable control. This does not affect any legal rights the client has.

18. Changes to these Terms

WholeMind may update these Terms from time to time. The version applicable to a purchase is the version made available before the contract is formed. Changes will not retrospectively alter a customer's agreed price or remove rights that have already accrued, except where required by law.

19. Governing law and jurisdiction

These Terms are governed by the law of England and Wales. Consumers may also have mandatory rights or protections under the law applicable to them that cannot be excluded by agreement.

20. Entire agreement and severability

These Terms, together with the information provided during the booking process, the applicable Client Service Agreement, and any applicable consent/confidentiality and privacy documentation, form the agreement governing the service. If any provision is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
